SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.
9. Indemnification
You agree to defend, indemnify, and hold harmless Dewey's Pizza, its owners, officers, directors, employees, agents, affiliates, suppliers, and licensors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

Except for disputes that qualify for resolution in small claims court, any dispute, controversy, or claim arising out of or relating to these Terms, the breach thereof, or your use of our services shall be settled by binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as amended from time to time. If a court or arbitrator determines that the class action waiver in this section is unenforceable for any reason, then the agreement to arbitrate shall not apply to that claim, and the claim shall proceed in court.
13.4 Waiver of Jury Trial
TO THE EXTENT PERMITTED BY LAW, BOTH PARTIES WAIVE THEIR RESPECTIVE RIGHTS TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF OUR SERVICES.
